Our staff at our in-house QualiSight call center is always on the phone looking for that next survey complete. Through our past 10 years of business, Research & Marketing Strategies (RMS) has had our fair share of respondents who answer our phone calls and mention that they are on the Do-Not-Call list and we should not be calling them, which is understandable. Telemarketers can often be very sly in disguising their phone calls to appear less salesy. At first, some market research survey calls may appear to be telemarketing calls, however, we often make it a point in our scripts to make it clear early on in the call that “this is not a sales call.” We certainly remove them from our sample but in fact, the Do-Not-Call list does not apply to a market research company like RMS.
RMS is a full-service market research company. Our primary research specializes in creating surveys and gathering first-hand information through surveys. We collect primary data through surveys and will never attempt to sell anything. The National Do-Not-Call Registry does not apply to charities and organizations conducting research or surveys. RMS is considered an exempt organization. Exempt organizations include charities or certain non-profit organizations, and organizations engaged in political solicitation or surveys.
If the call is really for the sole purpose of conducting a survey, it is not applicable to the National Do-Not-Call Registry. Only telemarketing calls are applicable to this list. Telemarketing calls are calls that solicit sales of goods or services. Callers purporting to take a survey, but also offering to sell goods or services, must comply with the National Do-Not-Call Registry.

[…] “I’m on the do not call list”. A phrase our QualiSight on-site call center here in Syracuse, NY hears sometimes from potential respondents over the phone. If you’d like more information on the Do Not Call List and how market research firms do not apply to these restrictions, read our former blog post about it by clicking here. […]
